1. 산업현장이나 건설현장에서 다양한 사고나 산업재해로 인한 사망사고 등은 많은 사회적 문제를 야기하고 있고(Various accidents or deaths caused by industrial accidents at industrial sites or construction sites are causing many social problems), 위 개별 현장들에서 재해가 지속적으로 발생되는 원인은 다양하지만(There are various causes of continuous disasters at the above individual sites) 근본적으로 기업에 안전보건관리체계가 제대로 구축되어 있지 않고 있었다는 과거의 반성적으로 이를 방지하고자 하는 차원의 산업안전보건법, 중대재해처벌법 등이 입법적으로 제정되어 실시되고 있다(The Occupational Safety and Health Act and the Serious Disaster Punishment Act were legislatively enacted to prevent the past reflection that the safety and health management system was not properly established in companies). 

산업재해가 발생하면 관련 적용법률에서의 요건들이 중요하고, 그 적용법령의 주체가 누구인지를 파악해야 한다(In the event of an industrial accident, the requirements of the relevant applicable law are important, and it is necessary to identify who is the subject of the applicable law). 종전 산업안전보건법이 근로자에 대한 안전 및 보건조치의무를 규정하고 있고, 1981년 제정된 이후 안전보건조치미이행죄로서 형사처벌까지도 규정하고 있음에도 형사적 법정형이 현저히 낮다는 지적과 함께 안전 및 보건조치의무미이행으로 인한 사망의 경우에는 상응하는 처벌규정의 공백이 있다는 지적이 있었다(Although the previous Occupational Safety and Health Act stipulates safety and health measures for workers and criminal punishment for failure to fulfill safety and health measures since enacted 1981, it has been pointed out that the criticism that the criminal court sentence is significantly lower and there is a gap in the punishment regulations for deaths due to failure to fulfill safety and health measures). 즉 현장감독자의 범위를 넘어 경영자까지 책임 범위가 확대되어야 한다는 필요성이 제기되었고, 산업재해를 넘어 시민재해까지도 포함해야 한다는 필요성이 있었다(In other words, there was a need to expand the scope of responsibility beyond the scope of field supervisors to managers, and to include civil accidents beyond industrial accidents). 그러다 2018년 12월 경 고 김용균씨 사망사고를 계기로 중대재해의 제정이 본격적으로 국회에서 논의되었고, 2021년 1월 국회를 통과하였다(Then, in the wake of the death of the late Kim Yong-kyun in December 2018, the enactment of a serious disaster was discussed in the National Assembly in earnest, and passed the National Assembly in January 2021.).

1) 먼저 산업안전보건법은 목적이 산업안전보건에 관한 기준과 책임을 가려 사업주의 의무와 행정관청의 관리감독 그리고 위반에 대한 처벌 등을 통해 근로자의 안전과 보건을 확보하여 산업재해를 예방하기 위함으로(First, the Occupational Safety and Health Act aims to prevent industrial accidents by ensuring the safety and health of workers through the employer's duties, supervision of the administrative office, and punishment for violations), 그 주체가 법인이나 개인사업을 불문하고 사업주가 그 주체가 되며, 보호하고자 하는 대상은 근로자, 수급인의 근로자, 특수형태의 종사가를 포함하며, 전 사업장에 적용된다(Regardless of whether it is a corporation or an individual business, the employer becomes the subject, and the targets to be protected include workers, contractors' workers, and special types of workers, and are applied to all workplaces)[안전보건관리체제는 50인 이상 사업장 적용(The safety and health management system is applied to workplaces with 50 or more employees)]. 

2) 근로자가 업무에 관계되는 건설물, 설비, 원재료, 가스 등에 의하거나 작업 또는 그 밖의 업무로 인하여 사망 또는 부상당하거나 질병에 걸리는 것을 산업재해라 하며(‘An industrial accident’ is an industrial accident when a worker is killed, injured, or sick due to construction, equipment, raw materials, gas, etc. related to work, or due to work or other duties) 그 중에서 사망 등 재해 정도가 심한 것으로서 아래에 해당하는 경우를 중대재해라고 한다(Among them, the degree of disaster such as death is severe, and the following cases are called ‘serious disasters’).   
3) 산업안전보건법에서는 프레스, 공작기계 등 위험 기계 혹은 폭발성 물질 등 위험물질 사용시, 추락 붕괴할 우려가 있는 위험한 장소에서의 작업 등에서는 적절한 안전조치를 취해야 하며(Under the Occupational Safety and Health Act, appropriate safety measures shall be taken (1)when working in dangerous places (2)where dangerous materials such as presses, machine tools, or (3)explosive substances or (4)a dangerous place are likely to fall and collapse), 유해 작업의 경우에는 산업안전보건기준에 관한 규정대로 보건조치를 하여야 한다(In the case of hazardous work, health measures shall be taken in accordance with the provisions of the Industrial Safety and Health Standards). 중대재해가 발생한 경우라면, 강화된 중대재해처벌법에 따라 안전 및 보건 확보의무가 현장에서 이루어지고 있었는지 여부가 사업주 또는 경영책임자의 형사적 처벌에 대한 책임까지도 문제된다(in the event of a major disaster, whether or not the duty to secure safety and health was carried out in the field under the Enhanced Serious Disaster Punishment Act is a matter of responsibility for criminal punishment by the employer or management manager). 

2. 위 중대재해처벌법은 경영자 측의 입장에서 우리나라의 안전구조에 대한 미흡 부분을 예방보다는 경영자에 대한 처벌에 초점이 맞춰져 있다는 엄벌주의 오류를 지적하고 있고(The above Serious Disaster Punishment Act points out the error of severe punishment from the management's point of view that it focuses on punishment for managers rather than preventing defects in Korea's safety structure), 특히 경영자에 의존도가 높은 중소기업은 경영자에 대한 처벌이 곧 회사에 대한 커다란 타격이 되어 문을 닫아야 할 것이라고 하고 있으며(In particular, small and medium-sized enterprises that rely heavily on managers say that punishment for managers will soon be a big blow to the company and have to close down), 노측은 제정 법안 원안에 있었던 발주처도 안전의무를 지우는 조항이 삭제된 점과 원청이 제3자에게 임대, 용역, 도급을 준 경우 안전보건 조치 공동의무가 아닌 원청이 시설, 설비 등을 소유하거나 그 장소를 관리하는 책임이 있는 경우로 한정한 점, 인관관계 추정 조항이 삭제된 점, 4년 동안의 단계적 유예기간이 있는 점 등을 들어 실효성이 없다고 주장하고 있다(The labor union also argue ineffective that deleted the clause imposing the safety obligation on the place of order in the original bill and limited it to cases where the original office is responsible for owning facilities, equipment, etc. or managing the place, not the joint duty of safety and health measures, the deletion of the provision for Causal estimation and the fact that there is a four-year grace period). 

3. 결국, 중대재해처벌법의 이해관계자인 노사측 모두 이 법안에 대해 그 누구도 만족하지 못하는 법안이 된 것은 사실이지만, 기존의 산업안전보건법에서 더 진일보하여 그 근로자의 보호대상을 넓히고 있고 중대재해처벌법에서 규율하는 산업재해가 시민재해까지도 포함하고 있으며, 그 형사적 책임을 강화하고 있다는 점은 법조계에서도 긍정적으로 바라보고 있다(In the end, labor and management, both an interested party of the Serious Disaster Punishment Act, are not satisfied with The present bill, but The legal profession is positive that the existing Occupational Safety and Health Act has expanded the scope of protection for the worker, including civil accidents, strengthening its criminal responsibility). 

중대재해처벌법이 시행되지 얼마 안된 시점에서 현재 산업재해가 발생한 현장들과 경영자들의 기소들이 뉴스에 종종 나오고 있지만 현재도 서울변호사협회 등에서 중대재해처벌법에 대한 수차례 세미나로 연구 중에 있으며 재판을 통한 법의 해석과 판례를 통해 조금더 완비된 법이 되기를 소망해본다(However, the Seoul Bar Association and others are still studying the Serious Accident Punishment Act as seminars on the Serious Accident Punishment Act, although the prosecution of industrial accidents and managers is often on the news. I hope to become a more complete law through interpretation and precedents of the law through trial). 

계단은 올라가라고 만들어진 것이고, 올라가는 길은 누군가에게는 험란하고 고통스러울 수도 있다(Stairs are designed to go up, and the way up can be rough and painful for someone). 하지만 계단은 올라야만 목적을 달성할 수 있고 사회도 진일보할 수 있는 것이다(However, you can achieve your goal only when you climb the stairs, and society can move forward).
